  1. General considerations

 

The website www.msecret.ro (hereinafter "msecret.ro", "Website" or "Site") is owned by clasic shop, a Romanian legal entity, with its registered office in Voluntari, Ilfov, bd. Pipera, no. 1, CUI 52250395, J2025057274008.This document, together with its annexes, sets out the terms and conditions for browsing and using the Website, as well as placing a product order through msecret.ro (hereinafter referred to as "Terms and Conditions"). Please read this Terms and Conditions document carefully and in full, as well as all other policies mentioned herein, before accessing and using msecret.ro, and consult them periodically. By accessing this Site and/or placing a product order, you agree to comply with the terms and conditions set forth below. Also, the use of any other current or future services provided by MSECRET implies the acceptance of the same Terms and Conditions.

The company reserves the right to modify the Terms and Conditions to comply with changes in law or our services, without prior notice. In this case, continued use of the Website after the posting of changes will mean that you accept and agree to the changes.

 

If you do not agree to comply with these Terms and Conditions, we ask that you stop using the msecret.ro Site.

 

  1. Intellectual property rights

 

www.msecret.ro is the exclusive property of clasic shop srl, protected in accordance with copyright law, is the rightful owner of all content available and displayed on the Site and/or on the company's social media pages (such as Facebook, Instagram, etc.), namely photographic, video, audio, text, graphics, illustrations, symbols, animations, logos, scripts, software and/or all types of files and information available on the Website, as well as all proprietary and non-proprietary rights resulting from the Website. 

 

The use of this trademark, domain name or trade names, logos and emblems, in direct or "hidden" form (such as, but not limited to, meta tags or other indexing, web search techniques) without prior written permission is prohibited and punishable by law.

 

You understand and acknowledge that you have no ownership rights over the Site, that you have no right to copy, transfer, modify, alter, sell, redistribute, decompile in any way the content of the Site, to use it, display it or include it in a context other than the original or to include it outside the Site. Also, it is not permitted to remove any signs indicating our copyright over the content.

 

  1. Use and access to the Website

 

Access to the Site is exclusively by accessing the address www.msecret.ro. When you use the Site, as well as when you register on the Site or place an order, you undertake to provide us with the necessary information and give your consent to process your personal data, in accordance with the Privacy Policy regarding the protection of personal data. Otherwise, we reserve the right to refuse your registration on the Site and to provide you with access to the functionalities available on msecret.ro. You warrant that the information provided when accessing, visiting, browsing or using the Website is true, accurate, complete, correct and not misleading.

 

  1. Registration on the Site and account creation

 

Your account can be created for free for your strictly personal use, in the "My Account" section, by filling in the form dedicated to new customers and activating the "Register" button, at which time you express your agreement regarding the processing of personal data according to the Site's Privacy Policy. You are obliged to keep confidential your access and login data to the account created on the Site and the set password. If you have forgotten or lost your password and/or it has been discovered by third parties, you are obliged to notify us immediately and to choose either to change the password or to close the created account. The company clasic shop srl is not responsible for losses suffered by you as a result of negligence regarding the security and confidentiality of your Account.

 

  1. Account deactivation

 

The account can be deactivated at your request, by accessing the "My Account" - "Delete account" section, or if you do not comply with the obligations stipulated in this Document.

 

  1. General information about the products offered on the Site

 

On msecret.ro we sell new products, in original packaging and deliver them with a tax invoice and a warranty certificate, in accordance with current legislation. The product offer is valid within the limits of available stock and in accordance with the provisions of this Document. If a product is no longer available in the current offer, we reserve the right not to honor that order.

 

According to legal provisions, the prices displayed on the Site do not include delivery costs, unless expressly stated otherwise. The final price on the invoice will be the same as that established by our sales consultant or an Msecret operator at the time of order confirmation.

 

The images displayed on the Site correspond to reality, but it is possible that some details of the products may differ slightly, depending on the photographic process or the settings or technical specifications of your monitor or device. The product that will be delivered will correspond to the color selected by you at the time of placing the order, but the color does not always coincide with the shade of the products in the images displayed on the Site. The images displayed on msecret.ro are illustrative for the model in stock. We reserve the right to change product images, offers or prices, without prior notice.

 

  1. Validity of promotional offers

 

We reserve the right to change the price for products available on the Site, without prior notice.

 

The purchase price of the products is that valid at the time of placing the order on the Site, within the limits of available stock. The price of promotional products will be that at the time of placing the order, within the limits of available stock and the promotional period, if it is limited.

 

Promotions/offers and price reductions are valid only during the period specified on the promotional materials, and prices are calculated according to the conditions mentioned therein.

 

Access to products on msecret.ro is allowed to both users who have or create an account, and those who do not wish to create an account, by checking the box "I want to order without a customer account", in the "Complete order" section. In any case, to complete the order, you undertake to provide us with your personal data necessary for processing the order, in accordance with the Privacy Policy, you agreeing to the provisions of the Terms and Conditions.

 

Account sharing between multiple customers is prohibited. If such access is discovered, we reserve the right to cancel or suspend your access to the shared account.

 

  1. Payment method

 

The following payment instruments can be used to pay for products purchased from the Site:

 

Cash on delivery (COD)

The value of the ordered products can be paid to the courier upon delivery, at the address specified by you.

 

Bank transfer

Payment can also be made by bank transfer, based on the proforma invoice, and the products will be delivered only after our account has been credited with the amount representing the value of the invoice.

 

By bank card

If you have chosen the "Online by bank card" payment method, you need to fill out a form with your card information on the payment processor's secure page.

 

For payments with credit/debit cards issued under the Visa and MasterCard logos (Visa/Visa Electron and Mastercard/Maestro), the 3D Secure system developed by the ePayment service is used. This system ensures the same level of security for online transactions as those made at an ATM or in a physical environment, at the merchant's. 3D Secure primarily ensures that no information related to your card is transferred or stored, at any time, on ElectroFun servers or ePayment servers, these data being directly entered into the Visa and MasterCard systems. In addition, 3D Secure is a system for authenticating the identity of cardholders in the electronic environment. The cardholder authentication process is based on a security code known only to the cardholder and takes place only on Visa or MasterCard servers, as the case may be. The 3D Secure system allows online purchases with any card issued under the Visa or MasterCard license, including debit and electronic Maestro and Visa Electron cards. Virtual cards issued by these organizations are also accepted. The company will issue the tax invoice in accordance with the provisions of the Fiscal Code, which will be sent to you along with the ordered products. We want to assure you that we will never request payment via email and you should ignore any such messages without initiating any payment.

Refused or canceled orders

In the event that a customer refuses to take delivery of an order or cancels the order after its confirmation, we reserve the right to request an advance payment before processing and shipping subsequent orders. The amount of the advance will be communicated transparently to the customer before finalizing the new order.

For certain products, especially those made to order, customized, or requiring special order, the Seller reserves the right to request an advance payment before confirming and processing the order.The amount of the advance will be communicated to the customer before finalizing the order and represents an express agreement between the parties, in accordance with the provisions of Article 1546 of the Civil Code.The order will be considered firm only after the advance payment has been made. In the absence of advance payment within the communicated deadline, the Seller reserves the right to cancel the order without any further obligation.In the event that the customer cancels the order for personal reasons, after order confirmation and the start of the execution process, the advance paid will not be refunded, as it serves to cover the costs already incurred by the merchant.By placing the order and paying the advance, the customer confirms that:

they are aware that the product is made to order;

they accept the loss of the advance in case of unilateral cancellation of the order;

they agree to the terms presented.

 

  1. Product delivery

Products ordered on msecret.ro will be shipped anywhere in Romania, through external express courier companies, and the delivery cost depends on the selected delivery method, in any situation being fully borne by you.

  • Products will be delivered within 1 day for orders confirmed by 12:00 PM and 1 or 2 days for orders confirmed after 12:00 PM, depending on the volume of orders. We reserve the right to confirm orders before fulfilling them, by contacting you by phone or email. The delivery period starts from the moment all order details have been validated and only after the order is validated by phone or email and/or from the moment payment has been made, as the case may be. If the courier does not find you at the specified address, the order will be cancelled and the product will be returned to our headquarters. You will bear the costs of a new delivery, regardless of the value of the ordered products. By taking over the products, you confirm receipt of the products in good condition, in accordance with your order.
  • We may delay or cancel the delivery of your ordered products due to situations beyond our control, such as actions by subcontractors or fires, explosions, floods, epidemics, strikes, government actions, wars, terrorist acts, protests, civil unrest or other force majeure events, in accordance with Romanian legislation.
  • In the event that delivery is not made for reasons attributable to the company, the maximum compensation amount that Msecret can pay to a customer is equal to the amount collected from that customer.
  1. Return Policy
  • Please carefully examine the information presented on this page, intended to assist you in correctly registering a return request for one or more products. All returns are processed via email. For returns of products purchased from Msecret to be accepted, it is essential that they are in the same condition as when they were delivered: products must not show signs of damage, wear, or washing, must not have stains or tears, and all original labels and seals must be intact.
  • Given the specific nature of the products we sell, we reserve the right to refuse the return of any product that does not meet these strict acceptance conditions. A returned product that cannot be resold as new will not be accepted, as it could compromise the health of future buyers. Please note that returning a product without its label and seal cannot be accepted under any circumstances. Products selected on the return form must be handed over in full to the courier, in the same form and condition in which they were received, within 14 calendar days from the date of receipt of the order. Otherwise, the return request will be rejected. In the event that products different from those mentioned in the completed form are included in the return package, we reserve the right to refuse to take receipt and register the return. The respective products will be returned to the customer at their expense.
  • Categories of products that cannot be returned:
  • For hygiene reasons and to protect consumer health, certain product categories are not eligible for return. These include underwear, swimwear, and earrings, as their subsequent handling and wearing could compromise the safety and health of new buyers. This restriction complies with the provisions of GEO 34/2014, art. 16, lit. e).Products made to customer's specified dimensions
  • Call Fan Courier to arrange for a courier to pick up the products you wish to return. Specify the pick-up address and destination address found in the form.Before returning any product, you must send a notification email to msecretbusiness@gmail.com. The refund of the money for the returned products will be made within 14 days.
  • Important aspects to note if you send us products that do not meet the return conditions:
  • We reserve the right to apply penalties or refuse product returns and associated refunds in the following situations:
  • 1. Products have been worn or have inappropriate odors: In this case, a 100% penalty will be applied, and the product will be returned to the customer at their expense.
  • 2. Products no longer have the attached seal or the labels are torn: In this situation too, a 100% penalty will be applied, and the product will be sent back to the customer, also at their expense.
  • According to GEO no. 34/2014, the company reserves the right not to accept the return of products which, by their nature, cannot be returned or which can degrade or deteriorate rapidly.

  • Given that current legislation does not provide for the right of return for legal entities, our return policy specifies that legal entities only have the right to product exchange, without return.

  1. Warranty
  • The commercial warranty of products covers only manufacturing defects. Products with physical defects, such as: tears, cracks, damaged, removed or modified warranty labels or seals, products used under improper conditions, and the like, are not covered by the warranty.
  1. Liability of the parties
  • You, as a user or customer, are fully responsible for all activities carried out through the Site and are also responsible for any material, intellectual, electronic, or any other kind of damage that may be caused to the Site, in accordance with the Romanian legislation in force.
  • No use of the content of the msecret.ro site is permitted for purposes other than those explicitly stated in this document.
  • The company is not obliged to transmit or provide content to the user by any means of communication (electronic, telephone, etc.), and accessing, visiting, or viewing any content does not imply such a contractual obligation on our part.
